Shorebound Terms of Use and EULA

1. Acceptance and Eligibility

These Terms form a legal agreement between you and Command B Limited for use of the Shorebound mobile application and related backend services (the "Service").

By installing, accessing, or using Shorebound, you agree to these Terms and our Privacy Policy.

Shorebound is intended only for users who are 18 years of age or older.

2. License Scope

Shorebound is licensed, not sold. Subject to these Terms, Command B Limited grants you a personal, non-exclusive, non-transferable, revocable license to use the app on supported devices you own or control, as permitted by the applicable app store usage rules.

You may not:

• reverse engineer, decompile, or attempt to extract source code except where law permits;
• resell, sublicense, lease, or commercially exploit the app without written authorization;
• use the Service in violation of law or these Terms.

3. Accounts and Access

• You may sign in using supported Apple or Google account flows.
• You are responsible for activity under your account and for maintaining account security.
• You must provide accurate information where required to use the Service.

4. Conduct and Safety Rules

Shorebound supports bottle and chat interactions, including communication with people you do not know. You agree not to use Shorebound to:

• harass, threaten, exploit, groom, coerce, or abuse other users;
• share unlawful, hateful, sexually exploitative, obscene, or self-harm encouraging content;
• share non-consensual intimate imagery, secretly recorded audio, or content that violates another person's privacy, publicity, or data-protection rights;
• impersonate another person, misrepresent your identity, or use misleading profile or account information to manipulate other users;
• scam, defraud, or solicit money, gifts, financial assistance, account credentials, verification codes, personal information, or favors;
• solicit romantic or sexual favors under false, deceptive, or manipulative pretenses;
• send spam, repetitive unsolicited messages, or attempt to pressure users into off-platform contact for suspicious purposes;
• use excessive profanity, sexually explicit approaches, unsolicited explicit images or voice notes, or repeated unwanted contact directed at another user;
• manipulate platform systems, evade safety controls, or create or use replacement accounts after restriction or ban;
• attempt to bypass moderation, safety controls, or rate limits.

5. User Content and Communications

"User Content" includes text, images, photos, voice notes, audio recordings, and other material you submit in Shorebound, including in current features and any future media-enabled bottle or chat features.

You retain ownership of User Content, but you grant Command B Limited the limited rights needed to host, store, process, moderate, reproduce, adapt (for example, formatting, compression, and transcoding), and deliver that content as part of operating, securing, and improving Shorebound.

You represent that you have the rights, permissions, and legally required consents to submit User Content, including for any person whose image, voice, or personal data appears in it.

You acknowledge that user interactions may involve strangers and that you are responsible for your own communications and choices in the Service.

6. Moderation, Reports, and Enforcement

We may investigate suspected violations of these Terms, review reports, and take enforcement action where reasonably needed to protect users, Shorebound, or the public. Enforcement actions may include warnings, content removal, chat restrictions, temporary muting, feature limits, account suspension, permanent bans, device or account-linkage blocking, and referral to relevant authorities where required by law, needed to respond to valid legal process, or necessary for serious safety risks.

Moderation may involve automated detection tools as well as human review. We may preserve relevant messages, images, audio/voice content, profile details, reports, device/account signals, and moderation records where reasonably necessary to investigate abuse, enforce these Terms, prevent fraud, protect users, handle specific disputes, respond to valid legal process, or comply with specific legal obligations.

We may take action without prior notice where we reasonably believe an account presents a safety, fraud, impersonation, harassment, or platform-abuse risk. Reporting and blocking features are provided to improve user safety, but cannot guarantee prevention of all harmful behavior.

7. Purchases, Entitlements, and Rewards

Shorebound may offer paid or promotional access entitlements through in-app purchase systems. Billing and renewal mechanics are handled by the relevant app store and payment infrastructure.

• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period in your store account settings.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Restores, refunds, and billing disputes are generally handled by the app store provider.

Shorebound may grant promotional access entitlements — including lifetime-style access rewards through programs such as feedback rewards — subject to eligibility, anti-abuse checks, and operational availability. The following terms apply to any such lifetime or permanent entitlement:

• "Lifetime" access means access for as long as Shorebound continues to operate and offer the relevant feature. If the service is discontinued, access ends at that time.
• Lifetime entitlements do not guarantee access to features or tiers introduced after the entitlement was granted, which may require additional payment.
• Lifetime entitlements are non-transferable and tied to your account.
• We reserve the right to modify, replace, or discontinue any feature or entitlement tier at our sole discretion.
• Access may be revoked without refund or compensation if you violate these Terms.

8. Third-Party Services

Shorebound relies on third-party infrastructure and integrations including Firebase/Google Cloud, PostHog, RevenueCat, WishKit, Loops, Slack moderation tooling, Apple, and Google services. Third-party services may have their own terms and privacy practices.

9. Suspension and Termination

You may stop using Shorebound at any time. We may suspend, restrict, or terminate access immediately, with or without notice, if you violate these Terms, present safety or fraud risks, attempt to evade enforcement, or where required by valid legal process, regulator or app-store obligations, payment requirements, or another specific legal or compliance duty.

You can request account deletion via in-app Settings. Deletion is permanent and cannot be undone.

10. Warranty Disclaimer

To the maximum extent permitted by law, Shorebound is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Command B Limited is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, goodwill, or business interruption arising from your use of Shorebound.

Where liability cannot be excluded, it is limited to the greater of (a) amounts you paid for Shorebound in the twelve months before the claim, or (b) EUR 50.

12. Governing Law

These Terms are governed by the laws of Ireland, unless mandatory consumer law in your place of residence provides otherwise.

13. Apple App Store Additional Terms

• This agreement is between you and Command B Limited, not Apple.
• The App Store license is limited to Apple-branded products you own or control under applicable usage rules.
• Apple has no obligation to provide maintenance or support for Shorebound.
• Command B Limited is responsible for applicable product warranties, to the extent not disclaimed by law.
• In the event of a valid warranty claim, Apple may refund the purchase price (if any), and to the maximum extent permitted by law has no other warranty obligation for Shorebound.
• Command B Limited is responsible for handling product claims, consumer-law claims, and privacy-related claims about Shorebound.
• Command B Limited is responsible for investigating and resolving third-party intellectual property claims related to Shorebound.
• You represent that you are not located in a country subject to relevant embargoes and are not on a prohibited/restricted parties list.
• You must comply with applicable third-party terms when using Shorebound.
• Apple and its subsidiaries are third-party beneficiaries of these Terms.
